Ken asks…

What happens when your car is totaled and the other driver was at 100% fault?

I was driving on a road that was undergoing construction in Southern California. I was driving at a safe speed where another vehcile made an illegal u-turn in the middle of the street and while I tried to avoid the car, I was still broadsided. My car is most likely totaled. The other party is admitting complete fault explaining that she thought that she was on a one-way street and had entered the street from the wrong side and suddenly decided to make a u-turn. She was looking the other way when she plowed into my car. The side curtain airbags deployed and the side door was completely crushed in and completely fell off.
My car is a 4-year old minivan that I bought brand new and paid $38,000. I added several extra’s post purchase.
In cases like this, I think the at-fault party’s insurance will pay the Blue Book value of the car only. However, after a 4-year depreciation, the perfectly running car is only worth $20,000. What can I do to recover the difference?

Wize Guy answers:

To be fair, You can’t expect to get the $38,000.00 that you paid for the van. You can only get fair market value at the time of the accident. If you think the Insurance company isn’t offering enough get a couple of written assessments from auto “experts”. If those estimates are higher than what the Insurance company is offering you, present them to the insurance company and insist they up their ante.
Ask your insurance company to help you. That is what you pay them premiums for. If they can’t/won;t help. Get another insurance company in case something like this happens again

Maria asks…

Can I get approved for a car loan if I am only receiving Unemployment Compensation?

My husband and I are trying to get approved for a joint car loan for $6,000.00. The car we are trying to purchase is $8,700.00, so we are paying the remaining amount out of pocket. Unfortunately, I am unemployed and receiving compensation and so is my husband, however his unemployment is only temporary due to his employer shutting down for construction, but he will be back to work full time within a month. We applied for the loan through the same bank that gave us our previous car loans which our now paid off and in good standing. We know our credit scores are some what decent in the mid 600′s with no serious negative accounts/collections. The debt we do have is minor and is always paid on time. I understand being unemployed definitely lowers our chances of getting approved, but being that our previous loans with them are paid off, were paid on time, and that my husband will be back to work full time in the next month, will the bank take that into consideration? Also the vehicle we are trying to purchase has retail value anywhere from $10-13,000 on Kelly Blue Book. So not only are we getting a good deal from the seller but the loan we’re trying to take out for the car is only half of the amount that the car is worth. Since the car has potential collateral for the bank, will they also take that into consideration? Is there anything I can do to help improve my chances of getting this loan if I were to be denied? Such as getting a co-signer, a letter from my husband’s employer confirming the date he’d be back to work? Thank you to all who answer.

Wize Guy answers:

I think you have a good case to put forwad – good repayment history, ok credit, gd security – but the main test for any lender is ability to repay.

They cannot refuse you a loan because you are unemployed (that would be discrimination), but what may happen is that you will likely fail the affordability test as you are both currently on a benefit.

That being said you have been a good customer in the past and your husband will be back at work shortly so they may give you the green light.

One option may be to borrow the money from a family member, signing a formal document with the vehicle as security?

B) A decent looking guy who is mechaniclaly inclined, a blue-collar…like a car mechanic, electrician, construction worker?
C) A blue-collar guy who looks like a thug and is the finest homeboy you’ve ever seen & who treats you right.
D) A slightly overweight stoner who luvs hanging w/ buddies getting high but who also works a 9to5 job?
E) An unemployed okay-looking kinda guy.
F) Your combination of the above.
Just curious…….no need to go in depth about chemistry, etc. I just wanna know if you are initially attracted to the man’s line of work or does his looks play a big factor on whether you’ll date him or not.
